Waiver of Pandemic Related SNAP Overpayments

The NYS OTDA received a special waiver from the USDA to waive certain SNAP overpayment claims that resulted from the pandemic. Specifically, these overpayments:  

  • Occurred during the Public Health Emergency (PHE) from March 13, 2020, through September 30, 2023;  

  • Were the result of either a misunderstanding or unintended error on the part of an applicant or recipient. For example, the applicant/recipient did not provide the local district with correct or complete information, or there was an agency error;

  • Was not related to an Intentional Program Violation (IPV), where an applicant or recipient purposefully withholds information to collect benefits or were discovered by the agency via a Quality Control (QC) review.

SNAP overpayments that do not meet the criteria above are not eligible for this waiver.
